The 72-hour guarantee

We guarantee that your company will be formed and your EIN issued within 72 hours. If we miss that, you get all of your money back — including the state filing fee we have already paid out and cannot recover.

This page explains the guarantee in plain language: what starts the clock, what "all your money back" covers, the one exception, and what the guarantee does not cover. The Terms of Service govern. Nothing here changes them — section 4.1 is the guarantee and section 11 is the refund policy.

What we guarantee

You pay $399 upfront. In return we guarantee that your company will be formed and your EIN issued within 72 hours. If we miss that, you get all your money back.

Two things, not one. The company formed with the state, and the EIN issued by the IRS. A guarantee that covers only the filing and leaves the EIN open is not the same promise.

Most orders are faster than this. Your EIN will arrive within one business day, Monday to Friday, of formation completing. 72 hours is the outer commitment we will refund against, not the expected turnaround.

What starts the clock

The 72 hours begins when we have all of these:

  • a complete application
  • three company name choices, in order of preference
  • full details for every owner
  • cleared payment

And one condition worth being direct about: if we have to come back to you with a question, the 72 hours starts again when you answer.

That is in the terms and we would rather you read it here than discover it later. It exists because the most common cause of delay is a detail we cannot proceed without — a name that is already taken, a spelling that does not match the application, an owner's details missing. We cannot control how quickly that comes back, so the clock does not run while we wait.

The practical version: send everything at once, answer any question quickly, and the guarantee runs uninterrupted. The three name choices matter more than people expect — supplying only one is the single most common reason we have to come back.

What "all your money back" actually covers

The full $399, including the state filing fee.

That is the part worth reading twice. Once we file with the state, that fee has been paid to Wyoming or Colorado and cannot be recovered by us. Our terms make it non-refundable in every other circumstance — and then carve out this one:

So if we miss the 72 hours, we absorb the state fee and you get the whole amount back.

For context: of the six other providers compared in our formation services guide, none guarantees a delivery date at all. doola's guarantee covers errors in its own service. Stripe Atlas refunds if it cannot support your business. Firstbase, Northwest Registered Agent and Clemta publish no guarantee. LegalZoom publishes the most detailed refund policy of the six and states that filing fees are never refundable. The one exception

The guarantee does not apply if the IRS or the relevant Secretary of State is closed, or their systems are unavailable, or they are subject to delays outside our control. If that happens we will tell you promptly. You may then choose to wait, or to take a full refund.

Government offices close, and their systems go down. We are not going to promise around something we do not control, and any provider who does is telling you something about their promises generally.

What the guarantee does not cover

It covers the company and the EIN. It does not cover:

  • A company name rejected by the state. This is why we ask for three choices. If all three are unavailable we come back to you, and the clock restarts when you answer.
  • A bank declining your application. We have no relationship with any bank and no influence over its decision. See below.
  • A change of mind after we have filed. At that point the state fee is spent.
  • A service already performed.

Before we file with the state, the position is simpler: full refund, no questions.

What we cannot guarantee, and will not pretend to

A US bank account. The bank decides on its own criteria and those criteria change. Anyone who guarantees you a US bank account is overstating what they control — be careful with them.

Note in particular that more than fifty countries and regions are excluded on residence, which no amount of preparation changes.

Renewals

The Compliance Plan is a separate, recurring service and has its own terms:

It renews automatically each year until you cancel. You may cancel at any time from your portal or by replying to any email from us. Cancellation takes effect at the end of the period you have already paid for. We do not refund part-used periods.

How to claim

Reply to any email from us, or write to hello@1dayein.com, and say the 72 hours has passed. You do not need to argue the case or fill in a form. We will check the timestamps on your order and, if we missed it, refund in full.
